The parents of the late Sidhu Moose Wala recently became parents again, however, it has led to controversy.

Balkaur Singh and Charan Kaur welcomed a baby boy on March 17, 2024, after undergoing IVF treatment.

However, Balkaur later claimed he was being harassed by the Punjab government over the legality of the newborn.

He stated that they have been asking him to provide documents to prove the legitimacy of the child.

Balkaur Singh said: “I want to request the government, especially Chief Minister Bhagwant Mann, to allow for all treatments to be over.

“I belong here and will come to any place you call me (for questioning).”

The Punjab government has now issued a show cause notice to Health Secretary Ajoy Sharma for acting on the Centre’s request for a report on the IVF treatment Charan Kaur underwent without notifying the Chief Minister and the Health Minister.

Calling it a “serious lapse”, the Punjab government asked Sharma to show cause within two weeks as to why proceedings under the All India Services (Discipline and Appeal) Rules, 1969 should not be initiated against him.

The notice stated: “Ministry of Health and Family Welfare, Government of India, sought a report from you regarding IVF treatment of Charan Kaur (Sidhu Moose Wala’s mother).

“In light of the provisions of Rules of Business, 1992 and given the significance of the issue involved, you were required to bring it to the notice of your minister-in-charge and chief minister and take their orders regarding further course of action.

“However, you proceeded to act in the matter without bringing this issue to the notice of your minister-in-charge and chief minister and without taking any orders from them.

“This is a serious lapse on your part.

“Hence, you are asked to show cause within two weeks as to why proceedings under the All India Services (Discipline and Appeal) Rules, 1969 should not be initiated against you.”

On March 14, 2024, the Centre wrote to the Punjab government, asking how Charan was able to undergo IVF treatment.

In December 2021, the government introduced the Assisted Reproductive Technology (Regulation) Act which imposes a strict age limit for IVF procedures.

Guidelines have an age range of 21-50 years for women and 21-55 years for men.

SK Ranjan, Director of the Department of Health Research, wrote a letter that read:

“Under Section 21 (g) (i) of the Assisted Reproductive Technology (Regulation) Act, 2021, the age limit prescribed for a woman going under assisted reproductive technology is 21-50 years.

“Therefore, you are requested to look into the matter and submit a report to this department of the action taken in this case as per the ART (Regulation) Act, 2021.”

Meanwhile, Punjab Health Minister Balbir Singh said it was the Centre that wrote to the state government on the matter and insisted that the AAP-led Punjab dispensation did not harass the family.

The controversy surrounding the IVF treatment administered to Charan Kaur has reignited discussions on reproductive rights and the ethical implications of assisted reproductive technologies.

Critics argued that it raises questions about the appropriateness of IVF treatment for older women and the potential risks involved.
